Terms & Conditions

These terms govern the relationship between Thiwa Sombat and each participant who enrolls in or otherwise engages with our financial education programs. We have written them in plain language wherever possible, and we encourage you to read them carefully before enrolling.

1. Definitions

Throughout this document, the following terms carry the meanings described below:

  • "Thiwa Sombat" / "We" / "Us" / "Our" — refers to the financial education practice operating under the name Thiwa Sombat, located at 46 Ari Soi 1, Phaya Thai, Bangkok 10400, Thailand.
  • "Participant" / "You" / "Your" — refers to any individual who inquires about, registers for, or attends any program or service offered by Thiwa Sombat.
  • "Program" / "Service" — refers to any educational course, workshop, advisory session, or related offering made available by Thiwa Sombat.
  • "Content" — refers to all materials, handouts, exercises, recordings, and educational resources provided as part of any Program.
  • "Agreement" — refers to these Terms & Conditions together with any enrollment confirmation or payment receipt issued to you.
  • "Website" — refers to the online presence of Thiwa Sombat accessible at https://thiwasomen.club.

2. Acceptance of Terms

By submitting an enrollment inquiry, making payment, or attending any Program, you confirm that you have read, understood, and agreed to be bound by this Agreement.

  • You must be at least 18 years of age to enroll in any Program.
  • You confirm that you have the legal capacity to enter into this Agreement under Thai law.
  • If you are enrolling on behalf of another person, you confirm that you have their authority to do so and that they agree to these terms.
  • If you do not agree with any part of these terms, we kindly ask that you refrain from enrolling and contact us to discuss your concerns.

3. Service Description

Thiwa Sombat offers educational programs for adults, particularly those aged 40 and above, covering personal finance topics relevant to life in Thailand. Current offerings include:

Financial News Reading Course

Two half-day sessions. Participants develop skills to read and interpret financial news with discernment, identify bias, and understand market reports.

Rental Income Management

Three sessions over two weeks. A practical program covering financial aspects of managing rental property, including tax obligations and tenant screening.

Chronic Illness Financial Adaptation

Six sessions over one month. A sensitive program supporting participants in adjusting their financial plans around chronic health conditions.

Programs are delivered in Bangkok unless otherwise communicated. Thiwa Sombat reserves the right to adjust session formats, dates, or delivery methods with reasonable notice. Geographic restrictions do not currently apply, though programs are designed for participants residing in or familiar with the Thai financial context.

4. Enrollment & Registration

  • Enrollment is confirmed upon receipt of full payment or a written confirmation from Thiwa Sombat.
  • Enrollment is subject to available capacity. We will notify you promptly if a program is full and offer alternatives where possible.
  • You are responsible for providing accurate contact information during registration. Thiwa Sombat is not responsible for missed communications resulting from inaccurate details.
  • Participants are expected to attend all scheduled sessions. Session recordings or make-up options are offered at our discretion.
  • Account-based access (where applicable) is personal and may not be shared with others.

5. Participant Responsibilities

We ask all participants to engage with our programs in a spirit of respectful curiosity. In doing so, you agree to the following:

Acceptable conduct:

  • Treat facilitators and fellow participants with courtesy and respect.
  • Engage honestly and openly in group discussions where relevant.
  • Use program materials solely for your own personal learning.
  • Notify us in advance if you are unable to attend a scheduled session.

Prohibited activities:

  • Recording, photographing, or copying session materials without written permission.
  • Sharing access credentials or program content with non-enrolled individuals.
  • Using program content for commercial purposes, resale, or redistribution.
  • Engaging in disruptive, harassing, or disrespectful behavior during sessions.
  • Misrepresenting the content of our programs to third parties.

6. Intellectual Property

All materials, frameworks, exercises, handouts, and session content developed by Thiwa Sombat remain our intellectual property and are protected under applicable Thai copyright law.

  • Upon enrollment, you receive a limited, non-exclusive, non-transferable license to use program materials for your personal educational purposes only.
  • This license does not permit reproduction, translation, distribution, or commercial use of any materials.
  • Any feedback, suggestions, or contributions you share with us may be incorporated into future programs without obligation to you.
  • The Thiwa Sombat name, logo, and branding elements may not be used without written permission.

7. Payment & Fees

Program fees are quoted and payable in Thai Baht (฿). Current pricing is as follows:

  • Full payment is required to confirm enrollment unless a written installment arrangement has been agreed.
  • Accepted payment methods will be communicated during the enrollment process.
  • Fees are inclusive of all program materials unless otherwise stated.
  • Prices may be revised for future program cohorts. Enrolled participants are not affected by price changes after confirmation.

8. Cancellations & Refunds

We understand that circumstances change, and we aim to be fair and reasonable in all cancellation situations.

  • 7 or more days before the first session: Full refund, less any processing charges incurred.
  • 3–6 days before the first session: 50% refund or the option to transfer enrollment to a future cohort.
  • Fewer than 3 days before the first session: No refund, though transfer to a future cohort may be considered on a case-by-case basis.
  • After the program has begun: No refund for sessions already delivered. Partial credit toward a future program may be offered at our discretion.

If Thiwa Sombat cancels or significantly reschedules a program, you will receive a full refund or the option to attend an alternative cohort. We will notify you as soon as reasonably possible in such circumstances.

9. Disclaimers

Our programs are provided for educational and informational purposes. Please consider the following carefully:

  • Content shared in our programs does not constitute licensed financial, investment, tax, or legal advice.
  • Individual financial circumstances vary. Participants are encouraged to consult appropriately qualified professionals before making significant financial decisions.
  • While we work diligently to ensure accuracy, financial information can change. Thiwa Sombat makes no representations regarding the completeness or timeliness of content after delivery.
  • Programs are provided in good faith on an "as available" basis. We do not claim that any specific outcome will result from participation.
  • Outcomes depend on many personal factors, and individual experiences will naturally differ.

10. Limitation of Liability

To the fullest extent permitted by Thai law:

  • Thiwa Sombat's total liability to any participant shall not exceed the fee paid for the specific program giving rise to the claim.
  • We are not liable for indirect, consequential, or incidental losses, including loss of income or financial loss, arising from program participation.
  • We are not responsible for events beyond our reasonable control (force majeure), including natural events, government restrictions, or infrastructure failures.
  • Nothing in this clause limits liability for personal injury caused by negligence, or for fraud, to the extent such limitation is prohibited by Thai law.

11. Indemnification

You agree to indemnify and hold harmless Thiwa Sombat, its facilitators, and associates from any claims, damages, or expenses (including reasonable legal costs) arising from your breach of this Agreement, your misuse of program materials, or your conduct during sessions. This includes any claims by third parties resulting from your actions.

12. Termination

Either party may end participation under the following circumstances:

  • By you: You may withdraw at any time, subject to the refund policy outlined in Section 8.
  • By us: We may remove a participant from a program if their conduct is disruptive, disrespectful, or in violation of these terms. In such cases, refunds will be considered individually but are not guaranteed.

Following termination, your license to use program materials ceases, and you are asked to destroy or return any physical materials provided. Sections 6, 9, 10, and 11 survive termination.

13. Dispute Resolution

We genuinely hope that any concerns can be resolved through open conversation. If a disagreement arises, we ask that you contact us directly in the first instance.

  • Informal resolution: Most concerns are resolved quickly when raised directly. Please write to us at [email protected] with a clear description of your concern.
  • Mediation: If informal resolution is unsuccessful within 30 days, either party may propose mediation through a mutually agreed mediator.
  • Governing law: This Agreement is governed by the laws of the Kingdom of Thailand. Any unresolved dispute shall be subject to the jurisdiction of the Thai courts.
  • Consumer rights: Nothing in this section restricts your rights under the Thai Consumer Protection Act B.E. 2522 or other applicable consumer protection legislation.

14. General Provisions

  • Entire agreement: This Agreement, together with your enrollment confirmation, constitutes the entire understanding between you and Thiwa Sombat regarding your participation.
  • Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full effect.
  • No waiver: Our failure to enforce any provision on a given occasion does not constitute a waiver of that provision going forward.
  • Assignment: You may not transfer your rights under this Agreement without our written consent. We may transfer our obligations as part of a business transfer, with reasonable notice to affected participants.
  • Notices: Formal notices under this Agreement should be sent by email or post to the contact details provided in Section 16.

15. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes in our programs or applicable law. When we do:

  • The revised version will be posted on our Website with an updated date.
  • For significant changes affecting enrolled participants, we will provide notice by email at least 14 days in advance.
  • Continued participation in any program after changes take effect constitutes acceptance of the revised terms.
  • If you do not agree with revised terms, please contact us before the effective date to discuss your options.
